Faking Stress Sick Leave after Warnings. How to Sack?

A staff who working for 4 months in a company. He was given a disciplinary warning for an indecent behaviour. He declared sick from the next day. He is on sick leave now for a month. A doctor who is related to him issuing “Stress At Work” sick note for every two weeks. Everyone knows that he is not Stressed. How to get rid of this headache?
Been told it is cost alot to sack someone who is on sick leave.

If he’s only been working for less than 1 year, he doesn’t have sufficient service to clam unfair dismissal and take you to an Employment Tribunal.

If he’d committed an act of indecent behaviour, he should have been dismissed instantly following a disciplinary hearing.

Give him the notice required under his contract, otherwise the period will be a week. Make sure he is paid all that is owed to him.

Speak to a solicitor and get your employment contracts checked over. make sure your disciplinary and grievance procedures are up to date. (Have a look at the ACAS website for this). Make sure you understand about the issues – you have dodged a possibly expensive and frustrating situation here but don’t get tripped up in future.
